DUTIES AND COMMITMENTS

I. The driver is aware that he is participating in a group activity, organised by REALIZA EVENTS SL, and directed by the person in charge of the activity designated by the organiser. Consequently, he undertakes to:

a. Follow the itinerary and travel plan stipulated in the contracted activity.

b. Strictly and meticulously follow the instructions given by the organiser and the person in charge of the activity, both direct and general instructions given through the intercommunication systems existing between the vehicles participating in the activity.

c. To give up the driving of the vehicle, at the request of the person in charge of the activity, as soon as the person in charge of the activity indicates it, undertaking to comply with it immediately and without discussion or protest about the suitability of the order.

 

Failure to comply with the duties set out in this section will result in the immediate exclusion of the driver from the activity, making the use of the vehicle on unlawful and immediately reporting this to the authorities and claiming personal liability for any damage he may have caused.

II. The driver is aware that the activity to be carried out consists of driving a vehicle on public roads. Consequently, he is required to:

a. Comply with traffic regulations, with respect to signs, traffic lights, instructions from agents and appropriate to the circumstances of the roads. The driver is exclusively liable for any infringements committed while driving the vehicle. The driver authorises the organiser to provide his personal data and a copy of this document to the administrations that require the identification of the driver of the vehicle. The driver is aware that, depending on the infringement he may have committed, if a claim had arisen as a result, he may be excluded from cover and may therefore be exclusively liable for the consequences of the claim.

b. Refrain from driving the vehicle under the influence of alcoholic beverages, toxic drugs, narcotics or any other substances, including medication, that could impair the driver’s ability and reflexes. The driver is aware that driving in such circumstances excludes insurance cover and he will therefore be exclusively liable for the consequences of any damage that may occur.

c. Refrain from transporting persons other than those covered by the activity contract signed with the organiser.

d. Refrain from transporting any animals, products or goods.

 

Failure to comply with these duties will give rise to the driver’s direct liability for any infringements he may have committed and, in addition, in the event that the insurance policy excludes cover for the loss that may have occurred as a result of such failure, it will also give rise to the driver’s full liability for the consequences arising from the loss. Similarly, the driver will be liable to the organiser and owner of the vehicle for any damage that may have been caused to the vehicle and for any penalties and compensation that may have been imposed on the organiser and owner for the driving performed by the signatory.

III. The driver is aware that he is using a third-party vehicle and is therefore required to:

a. Immediately inform the person responsible for the activity of any incident that may arise while driving the vehicle.

b. Refrain from starting or continuing the journey if he notices any malfunction in the operation of the vehicle.

c. Stop immediately if a light on the dashboard comes on and contact the person responsible for the activity to assess whether the vehicle should continue to be used.

d. Protect the vehicle from theft when stopping on the road (windows must be closed and the central locking system blocked).

 

Failure to comply with these duties will give rise to the driver’s direct liability to the organiser and owner and to third parties for any damage that may have been caused.
